Summary: The accused are charged with engaging in a project without proper planning and abuse of office in relation to the construction of Trans Nzoia Referral Hospital in Kitale. It was alleged that the accused persons awarded the contract to Vipul Ratail Rodhia via direct procurement without the tender committee making the decision to make direct procurement. It was also alleged that as a result of the actions of the accused persons there was a theft of Kes. 185 million. The prosecution however proceeded to file for withdrawal based on direction by the DPP based on the decision of a superior court that EACC as constituted at the time they were investigating this case wasn't properly constituted. The application was granted and the case was withdrawn.
